The Court Case Goes On

The Scenic Pit LLC court case continues to be a topic of conversation and action. Residents continue to be upset that their lives could be in turmoil for the next 10 years or more with dump trucks coming past their homes every 15 minutes as well as going past the Amy Belle School. 

Now that the WI Circuit Court District 2 ruled in favor of Scenic Pit LLC the village decided to continue to fight to the WI Supreme Court. Last Friday the village submitted an appeal to Wisconsin Supreme Court asking the court to hear their case. 

Jeff Gonyo, alluded, at the July Village Board meeting, that the state supreme court only takes about 5% of cases submitted so in his opinion this case has a small chance of getting heard.

Jim Healy Village Administrator said, “This case impacts not only Richfield but the whole of the State of WI and therefore we hope the court will hear the appeal."

​Only time will tell.

Meanwhile, I see more and more houses for sale in the area wanting to get out before the destruction of the area happens. What ever happened to being good to your neighbors and not trying to hurt them with contaminating their community (water, traffic, air, etc)?

Jeff needs to pay his $$ to the village. until then, his voice is nothing more than yada yada yada. Does not pay taxes in Richfield, so are far as most people think, he has NO voice

And in the end, whether you have the ruling on your side or not, you have to wonder about a person that would do this to her community. Just because it's legal doesn't make it the right thing to do. This continues to be about her getting what she wants and the money, regardless of the effect on other people and how they feel about it.

I sent the following letter to the op ed of the Milwaukee Journal today relative to the favorable article they published about Scenic Pit.

After reading your article about the Scenic Pit landfill, I would like to tell the rest of the story about Danah Zoulek, as she is not the aggrieved party she claims to be. I live about a mile away from the Scenic Pit, and the public should be aware that the large expensive homes around the pit are not the only properties involved; there are hundreds of us that live along the two lane country roads that will be used to deliver fill, who have modest means, and many of whom have also lived in the community for most of our lives.

For many of us, our home is our largest asset. This is not just mass hysteria, or the NIMBY (not in my backyard) syndrome, as there are serious issues at stake here, not the least of which is the possibility that this operation will contaminate the water table that feeds our private wells. It is my understanding that the DNR has acknowledged that they do not have the resources to monitor whether clean fill goes into that pit, and Ms. Zoulek is being very disingenuous about this. Having the contractors dumping fill sign an affidavit that the fill is clean means absolutely nothing. Scenic Pit is an LLC, and Ms. Zoulek will become an overnight millionaire from this operation, yet in the event that this operation does contaminate our water supply, she assumes no personal responsibility for any future liability. Also, the taxpayers of the Village will have to bear the cost of continuously repairing/replacing all the public roads that are not equipped to handle the constant traffic and heavy loads. Another unmentioned concern is that there will be an estimated 100 plus trucks a day (for up to 10 years) zooming by an elementary school all day long. The fact is that is is not a handful of homeowners who object to this, it is a large majority of the community.

I have no doubt that this operation will destroy our quality of life because of the dust, noise pollution, and dangerous traffic patterns. I also have no doubt that if this operation is to go forward, our property values will drop overnight; who would knowingly want to live along a 3 to 10 year construction zone?

Ms. Zoulek paints a noble picture of herself as a “mother, war veteran, small business owner,” etc. In fact, most people who have met her know that she is a lousy neighbor, does not pay her bills (see Wisconsin Circuit Court Records), and is in the habit of picking fights with anyone who crosses her path. Ms. Zoulek’s motivation is purely greed, and she could not care less that this operation will destroy the quality of life and property values for her neighbors. Right now she lives on the pit, but I am certain that once the money starts rolling in, she will not stick around live with the carnage that will be going on. Scenic Pit LLC is of absolutely no benefit to the community at large.
