Landfills in Residential Subdivision Areas

​There are multiple immediate actions to take that are very important to opposing the proposed residential landfill on Scenic Road.  It is critical that WI judges, legislators and the governor’s office hear from as many people, more than one per household, as possible. Now is the time for action!

Richfield citizens are asking for legislation for clean-fill landfills to be regulated through the same steps as other landfills. This means that clean-fill landfills should not be exempt from any locational  criteria or performance standards in NR 504.04(3) (a-i) AND 504.04(4) (a-f). Clean-fill landfills need to conform to NR 500 to 538.

Scott Walker's office oversees the DNR. Richfield citizens are asking for the DNR to use its authority to declare that this landfill is a threat to our water supply.

Important Points:
1. Richfield residential drinking water is ~15-20 feet below the surface of the pit.
2. The pit is a large part of the recharge source of water that we drink.
3. There are wells, homes and bodies of water very close to the proposed landfill site:
· 40 wells within 1,200 feet
· 77 properties within 1,200 feet
· Bark River and a Floodway Zoning District/Flood Storage within 1,200 feet
· Bark Lake within a 0.5-mile radius
· 894 properties within a 1-mile radius
· 1000 properties within a 2-mile radius
4. There is an elementary school within 1 mile of the proposed landfill site.
5. Clean-fill concrete, paint, and asphalt have toxins that leach into water.
6. Lead chromate used as yellow paint on roads in the past could be dumped into this landfill.
7. Materials entering the landfill are not tested before dumping and it will be too late when Richfield water is contaminated.
8. Noise, traffic, and dust are serious public nuisance concerns.

Can we get the landfill on 175 across from Piggly Wiggly shut down as well?

It's up to the courts and if we don't let the legislators know . Then we are just going to have to put up with it. I hope people stress their feelings

At the risk of snail mail getting delayed or lost (or not opened due to security risks), I have opted to FAX my letter to the individual Justices, Chief Justice Patience D. Roggensack, Justice Annette Kingsland Ziegler, Justice Rebecca Grassl Bradley and Office of Justices (608) 261-8299 (Fax). Email is not an option with that department. I have also sent emails to Gov. Scott Walker, Alberta Darling, and Jim Sensenbrenner.

The village's paramount concern has been, and continues to be, the shallow aquifer which lies directly beneath the ground's surface among several other concerns.

Response from Alberta Darling's office:

Thank you for contacting Senator Darling’s office. It is a pleasure to hear from you.

Senator Darling appreciates you contacting the office to discuss the surrounding statutes regarding clean fill. Wis. Stat. § 289.43 (8) (b) 1 allows the department to promulgate rules specifying types of solid waste. The Department of Natural Resources (DNR) used this authority to promulgate regulations surrounding clean fill (see Wis. Adm. Code NR 500.08). Clean fill is not explicitly mentioned in statute. As there is the potential for this case to be appealed, the Senator considers this litigation ongoing. Therefore, Senator Darling respectfully declines to comment on this issue.

We have been informed that the DNR is in communication with the Village of Richfield to gain a deeper understanding of the regulatory regime surrounding clean fill. We are confident the DNR will be able to provide clarity on this matter.
