Fox 6 reporter asks about Drone film

Today just after the court decided in favor of the Village of Richfield  and denied judgement for Danah Zoulek and her desire to have a land fill a Fox 6 reporter asked some people at the Washington County court house if anyone knew about a Drone video on a web site. 

He asked, "Did anyone know who took the video and put it on a web site"? He said he was doing another story on Drones and that is why he attended the court hearing. He also said he had been asked by Danah Zoulek to attend the hearing.

Hopefully you all will be able to see that story on Fox 6 in the near future to get added information. In the meantime, research into the matter of Drones does not produce a final answer to where they can fly but here is a great article that might shed some light on the subject.

they need to know the laws governing drones. would they call the sheriff if I was flying a hand glider over their land, and taking pictures.?

Marie, again you are misinformed,or don't know what you are talking about! I posted a long time ago where to find drone ( A.K.A., U.A.S. vehicles ) rules and regulations.
Your ignorance is disrespectful and appalling! I know i said i wouldn't respond to you anymore,but you obviously have no clue on Drone usage! You are the one that doesn't know the laws! If you fly anything over someones property and it is not purely for recreational use,take pictures and use the pictures for business purposes there are permits needed and regulations to follow. Not doing this is in violation of Federal Law!

As posted on this blog,the skies over the U.S. belong to the Government,not an individual,that is why there are rules and regulations, yes,even for flying a hand glider! It does not matter if it is powered or not.

The overfly of the Drone over Tom and Danah's property clearly was business in nature as it was made for some type of Geological Survey,or to report on any activity at their property and then it was put on a business website, a very clear violation of Federal Law if the Drone operator, and/or the business ( R.R.A.D. ) which they claim to be a bonafide L.L.C. did not have the proper permits,or land owner approval. Also,if you are flying for recreational purposes, your vehicle that you are flying has to be kept in what is known as line of sight,which means you have to be in eye contact at all times with the vehicle and fly it without the aid of a camera(s). Another rule is if you are using a Drone for business purposes,you have to notify any airport within 5 miles of your planned flight. I believe that the private airstrip at the intersection of Hwy.175 and Willow Creek Rd. would fall into that category.

My Dad and my brother are both pilots and my family has been around aviation all our lives,including belonging to the A.M.A. ,which is the governing body for model aircraft, so i'm sure we are much more versed on how things work in aviation then you are Marie.

You know ,just because you or whoever else think's something is right,doesn't automatically make it so! Diane, you could be professional and post this comment because it is factual and not any more derogatory than Marie is. Marie,you need to go on the FAA website and you will find that what I have posted is the truth and factual.

Diane,the article on Drones that you said might shed some light on the subject is 2 years old and not very definitive,even though it does bring up some of the issues of U.A.S. flying.


Again Federal law states you need permission and Permits to operate a Commercial Business with a U.A.S. . People can't just do what they want because they have a ( us against them mentality ).

As I said in my earlier post to Marie, a person needs to go to the Federal Aviation Administration website to get definitive information on the use of U.A.S. . The whole spectrum of rules and regulations is still in it's infancy,but the regulations I posted earlier are already in place.

The article states ( The operator of a Commercial Drone needs a special Test Certificate from the FAA to operate its flying vehicle ).

The overflight of Tom and Danah's property by a Drone was definitely a Commercial venture since it was obviously made and posted by R.R.A.D. to show what or wasn't going on at the Zoulek's property!
People will be learning more about this in the near future.

Well!! I guess I will need to read up since real estate companies are doing this. That must mean they are Against the rules. I will have to call a real estate company and ask if they have permission. Ignorance vs misinformed! Hummmm!

Marie, again, it's not against the law to use Drones in a business setting, but you have to have the permits and license to do so.

There was a guy who overflew a college campus to film the grounds for a third party business. He did so without the Colleges permission and was subsequently fined $10,000.00.

Like I said,the rules and regulations for Drone use is still in it's infancy.

Just because those companies use Drones doesn't mean they have the permits to do so. People in general probably don't even know that they need permits and a license, but ignorance of the law doesn't mean that they won't get prosecuted.

What is a petition for exemption?
A. A petition for exemption is a request to the FAA by an individual or entity asking for relief from the requirements of a current regulation.

Do I need a Section 333 grant of exemption if I'm not charging for my services?
A. Unless you are flying only for hobby or recreational purposes, you will need FAA authorization via a Section 333 grant of exemption to fly your unmanned aircraft system (UAS) for your business. This applies even if you are only flying to supplement or aide your business and not charging fees for doing so.

The FAA just published new rules for operating small UAS commercially. Do I still need a Section 333 exemption?
A. Yes. The Small UAS Notice of Proposed Rulemaking (NPRM) was published in February 2015, and the public comment period closed in April 2015. The FAA must analyze all comments received before issuing the final small UAS rule. Until a final rule is issued, no part of this rule is in effect and current regulations continue to apply, meaning that commercial operators must petition for and receive a Section 333 grant of exemption.

If I receive a Section 333 grant of exemption, can I do whatever I want with my UAS?
A. All Section 333 grants of exemption are issued with conditions and limitations that the operator is responsible for complying with. The FAA publishes all Section 333 grants of exemption, on its UAS website:

The operating conditions and limitations associated with each authorization are listed within the grant of exemption document.

Is there a fee associated with the Section 333 exemption process?
A. There is no fee associated with petitioning for exemption. However, all aircraft operations conducted under a Section 333 grant of exemption must use a registered UAS, and there is a minimal fee associated with registration. Details are available at:

Marie, you haven't responded to the information about the U.A.S. rules and regulations I posted ? Is it because that you realize that it is more than just flying a hand glider with a camera!?

There is also guidelines for local law enforcement on how to proceed in matters such as the overflight of Danah and Toms property.

People can't just take matters into their own hands and just do what they want, just because they don't like something!

Even if Danah and Tom's plan or business venture is unpopular with some people, it doesn't justify the way they have been verbally and physically attacked!

What if that DRONE flyover would have spooked the horses on the property and somebody would have got hurt or worse!!!

Danah and Tom's children are nearly always interacting with the horses! That is one of the reasons that they spend time out there!

So many times people have posted on this blog how they want to have their ( COUNTRY WAY OF LIFE ) ,why aren't Tom and Danah entitled to the same!

Robert! my issue is with the PIT. As far as the drone, I am not involved with it. your information was from the web site that I already looked at. It really does not really cover the Drones and their uses and that is why law makers are trying to put laws in place. I am not sure if we have any local ordinance restricting a drone or it use. Until I find an ordinance, law or actual law case, I will not say any more..

If you can't understand what the FAA has to say about the current DRONE LAWS then you truly need some guidance!

The information I sent to this blog about DRONES is quite specific about the RULES and REGULATIONS!

Marie, when you don't follow the RULES and REGULATIONS of the FEDERAL GOVERNMENT, it is BREAKING the LAW!

Again, I don't know why I try to explain things to someone who JUST DOESN'T GET IT!!!

What part about RULES and REGULATIONS don't you understand??

The FEDERAL GOVERNMENT does not work with ORDINANCES!
I am tired of wasting my time,all you want to do is argue and be controversial!!

Diane,what is the problem? Is the truth and reality of the issues with the pit coming into focus now!?

People WILL see the truth and facts in the near future, there is no doubt about it. As I said before, the truth will prevail, and all of the bullying and ignorance will come to light!!
There is more behind the scenes than people realize!
As was quoted before, people have picked the wrong family to try and intimidate! IT JUST MAKES US STRONGER!!!!!!!!
