Village of Richfield Wins

6/30/2018

Village of Richfield wins final case against Carla Whitcomb where she allowed people to reside in a commercially zoned building for years. This win finalizes numerous court cases against Ms. Whitcomb over many years.

The property is zoned M-3, or for businesses, rather than residential and the village was seeking forfeitures from two years of violations. Other than residential users, tenants at 3090 Polk St. include a diesel mechanic, a towing business, an auto repair business and others, according to the decision.

Whitcomb's decision to allow individuals to reside on the property at issue has been the subject of lawsuits in Washington County for nearly a decade as noted in the appeals court decision.

It is unlikely the village will receive any payment of those violations nevertheless the unsafe situation has been stopped once and for all.

The 58th Assembly seat is now held by Rick Gundrum. Not sure if there will be a forum for this district as there is no primary. Election will be in November.

Bernie Newman has been the President of CSCWC since 2017. He conducts very honest and effective meetings which have been greatly improved since he became President.
